Koen Bijvank specialises in international patent litigation and regularly appears both in the courts and before the European Patent Office. His practice mainly involves patents in the areas of chemistry, pharmaceuticals and life sciences. Koen is the chair of the Standing Committee on Patents of AIPPI and past-president and co-founder of EPLIT, an association of European patent litigators.

Our speakers will give you an overview of the opt-out process and delve into opt-out/optin strategic considerations. A feature of the course is the live demonstration of a generic opt-out in the UPC case management system.
The Unified Patent Court (UPC) is currently in the Provisional Application Phase. It is expected that the Court starts its operations early 2023, triggered by the entry into force of the UPC Agreement on the first day of the fourth month after the deposit of the German instrument of ratification as soon as the Administrative Committee is confident that the Court is operational. As the UPC further notes, the German deposit will also mark the start of the sunrise period during which it will be possible to opt out existing European patents from the jurisdiction of the Court.
It is crucial for patent owners and their counsels to know how to declare the opt-out for which patents in their portfolio. Our speakers will give you an overview of the opt-out process and delve into opt-out/opt-in strategic considerations.
