Dr. Klaus Grabinski is judge at the German Federal Court of Justice and deputy presiding judge of its Patent Division. He was for many years presiding judge of one of the patent litigation chambers at the Regional Court Düsseldorf. Since 2021 Dr Grabinski is an external member of the Enlarged Board of Appeal of the European Patent Office. He is, inter alia, co-author of the 'Benkard'- Commentaries on the German Patent Law (12th ed., 2022) and on the EPC (4th ed., 2022).

M. Jur. (Oxford), Attorney at Law and partner, Hogan Lovells International LLP, Munich (Germany)
is a German trained and qualified Rechtsanwalt and partner and head of the patent litigation team of Hogan Lovells in Munich. He has litigated hundreds of patent infringement and validity cases for his clients at all major German courts and the EPO. He is co-author of 'Unified Patent Protection in Europe' (OUP, 2018) and Tilmann/Plassmann, 'Unitary Patent Protection' (Beck, 2022).

This online course deals with the proceedings at the Unified Patent Court.
One must imagine Sisyphus happy, wrote French philosopher Albert Camus. Whether the European patent practitioners will be happy with the future Unitary Patent remains to be seen. The development of the European Patent Package sounds like the story of Sisyphus. Regardless, the first Unitary Patents will be granted in the near future. Thus, on one hand, it will be necessary to attack infringers of Unitary Patents and of European bundle patents - subject to an opt-out - before the new Unified Patent Court. On the other hand, it will also be necessary to defend against Unitary Patents and European bundle patents of competitors with revocation proceedings. While the application procedure remains largely unchanged, knowledge of the infringement and revocation proceedings before the Unified Patent Court is thus a prerequisite for the inclusion of the new Unitary Patent in your patent strategy, your FTO and patent enforcement considerations. In the course of the seminar, you will receive a thorough overview of the proceedings before the Unified Patent Court and learn what your options are as a plaintiff or defendant.
